Welcome to Mil Apparel. These Terms of Service ("Terms") govern your access to and use of milapparel.com (the "Site") and any products, services, content, or features made available through it (collectively, the "Services"). The Site is owned and operated by Mil Apparel ("Mil Apparel," "we," "us," or "our").

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, Shipping Policy, and Refund Policy, which are incorporated here by reference. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or create an account. By using the Services, you represent and warrant that you meet this requirement and that all information you provide is accurate and current. Minors may use the Site only with the involvement and consent of a parent or legal guardian.

2. Accounts

You may browse the Site without an account, but certain features require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact information below if you suspect unauthorized use. We reserve the right to suspend or terminate accounts at our discretion, including for violations of these Terms.

3. Products, Pricing, and Availability

We work to display our products accurately, including colors, designs, sizing, and descriptions. Because monitor and device displays vary, actual product colors and finishes may differ slightly from images shown on the Site. Slight variations in print placement, fabric texture, and finish are normal for the apparel printing process and are not defects.

All pricing is listed in U.S. dollars unless otherwise noted and is subject to change without notice. Promotions, including free shipping thresholds, sales, and discount codes, are subject to their stated terms and may be modified, suspended, or ended at any time.

Product availability is not guaranteed. We reserve the right to limit quantities, refuse or cancel orders, and discontinue any product at any time. In the event of a pricing or product listing error, we reserve the right to cancel any affected orders, whether or not the order has been confirmed and charged, and to issue a full refund.

4. Orders and Payment

Your submission of an order constitutes an offer to purchase. No order is binding on Mil Apparel until we accept it, which occurs when we ship the order or send a shipping confirmation. We may reject or cancel any order at our discretion, including for suspected fraud, payment issues, inventory issues, or violations of these Terms.

Payment is processed through Shopify and its supported third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us, through our payment processors, to charge the full order amount, including any applicable taxes and shipping fees.

5. Shipping and Delivery

Shipping options, costs, processing times, and delivery estimates are described in our Shipping Policy. Title and risk of loss for all products pass to you when the carrier accepts the package from us. Delivery dates are estimates only and we are not liable for delays caused by carriers, weather, customs, or other circumstances outside our reasonable control.

6. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Refund Policy. By placing an order, you agree to the terms of that policy.

7. Intellectual Property

All content on the Site — including but not limited to designs, graphics, illustrations, photographs, product images, logos, marks, names, slogans, text, and the overall look and feel — is the property of Mil Apparel or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, sell, or otherwise exploit any portion of the Site or our products without our prior written consent. Any unauthorized use immediately terminates your license.

8. Military Affiliation Disclaimer

Mil Apparel is a privately owned, veteran-operated apparel brand. We are not affiliated with, endorsed by, sponsored by, or officially connected to the United States Department of Defense, the United States Army, the United States Marine Corps, the United States Navy, the United States Air Force, the United States Coast Guard, the United States Space Force, or any other branch, command, or agency of the U.S. government or military.

References to military branches, units, insignia, mottos, callsigns, designations, and related cultural elements are used for expressive and commemorative purposes to honor those who serve and have served. All third-party trademarks and references are the property of their respective owners.

9. User Content and Submissions

If you submit reviews, comments, photos, design ideas, or any other content to the Site or to our social media channels referencing the Site (collectively, "User Content"), you grant Mil Apparel a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that User Content in any media and for any lawful business purpose, including marketing.

You represent and warrant that you own or have the necessary rights to the User Content you submit, that it does not violate the rights of any third party, and that it does not contain unlawful, defamatory, obscene, threatening, hateful, or otherwise objectionable material. We reserve the right to remove any User Content at our discretion and without notice.

10. Prohibited Conduct

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms or any applicable law;
Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;
Use any robot, scraper, or other automated means to access the Site for any purpose without our express written permission;
Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
Submit false, misleading, or fraudulent information, including payment information;
Infringe the intellectual property or other rights of Mil Apparel or any third party;
Resell or otherwise commercially exploit products purchased from the Site without our prior written consent;
Harass, abuse, or threaten our employees, agents, or other users.

11. Third-Party Links and Services

The Site may link to or integrate with third-party websites, applications, or services (including Shopify, payment processors, shipping carriers, and social media platforms) that we do not own or control. We are not responsible for the content, policies, practices, or availability of any third-party service. Your use of any third-party service is at your own risk and subject to the third party's own terms.

12. Disclaimers

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, MIL APPAREL DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that defects will be corrected. No advice or information obtained from the Site creates any warranty not expressly stated in these Terms.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MIL APPAREL, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCTS OR SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MIL APPAREL FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mil Apparel and its owners, officers, employees, agents, and suppliers from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to (a) your use or misuse of the Site or any product, (b) your violation of these Terms, (c) your violation of any rights of any third party, or (d) any User Content you submit.

15. Governing Law

These Terms and any dispute arising out of or related to them, the Site, or any product or service are governed by the laws of the State of California, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Dispute Resolution

Informal Resolution. Before filing any formal claim, you agree to first contact us at the email below and attempt to resolve the dispute informally for at least thirty (30) days.

Binding Arbitration. If the dispute is not resolved informally, you and Mil Apparel agree to resolve any claim through final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with the arbitration seated in Los Angeles County, California, conducted in English, by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. You and Mil Apparel agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

Exceptions. Either party may bring an individual action in small claims court, and either party may seek injunctive or other equitable relief in court to protect intellectual property rights.

Opt-Out. You may opt out of the arbitration and class action waiver provisions by sending written notice within thirty (30) days of first accepting these Terms to the contact address below, stating your name, order or account information, and a clear statement that you decline arbitration.

17. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all provisions of these Terms which by their nature should survive will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the new Terms on this page. Material changes will be reasonably communicated, such as through a notice on the Site or by email if you have an account. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

19. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified only to the minimum extent necessary to make it enforceable. These Terms, together with the policies referenced above, constitute the entire agreement between you and Mil Apparel concerning the Site and supersede all prior or contemporaneous communications and proposals.
